My guess is that he told BB he was on AGT but had been eliminated and was clear to be on BB. But though he may have taped his not moving foward, it has not yet aired (they are still doing auditions), so his appearing on BB would spoiil the story for AGT. I expect NBC's lawyers contacted CBS's lawyers and said they aren't done with him yet. For this season, Marvin just didn't have any chemistry.
