Out of court settlement as Idol creator sues Cowell

Simon Cowell will remain with American Idol after an out of court settlement was reached after he was sued by Idol creator Simon Fuller.

Fuller claimed that Cowell's hit UK show The X Factor was a rip-off of Pop Idol, the original UK version of the show that spawned American Idol and many others.

Cowell refuted the claims, noting that The X Factor was no more similar to Pop Idol than Pop Idol was to Popstars, an earlier format which first introduced the concept of nasty judges and open auditions to our screens.

As part of the deal Cowell will take a greater cut of the profits of American Idol - but Simon Fuller will now take a 20% cut in any profits from The X Factor. It's also possible the deal could pave the way for The X Factor to eventually make it's way to US screens.

While it has some similarities, there are some quite significant differences between The X Factor and Idol.

The X Factor begins with open auditions - open to all soloists and groups over 16. The three judges - Simon Cowell, Sharron Osbourne and Louis Walsh - decide who goes through to the next round.

The acts are split into three categories - 16-24, 25 and over and Groups, with the judges each mentoring one group.

The artists progressing to the live shows are selected through first a Bootcamp, where they are cut down to 7, then through a final stage at the judges homes, where the final four in each category is named.

The live shows begin with acts performing live each week for the viewers vote. There is a twist though, as it's the bottom two who are not safe. They must sing again in the "Final Showdown" before the three judges vote to determine who is eliminated from the competition.

WOW! That is a much better format. You still have audience input each week in determining the bottom two - but then some impartiality enters the picture when the JUDGES determine who if the bottom two goes. Maybe that is the way Idol should have worked...
