LoFo Posted August 22, 2007 Share Posted August 22, 2007 just thought you'd like to hear a legal point of view- blowing smoke in someone's face IS an assault, in many jurisdictions. the smoke, though "transparent" is actually capable of "touching" which is the definition of assault (an offensive touching). so dick's blowing smoke in jen's face is just as much an assault as her going after his cigarette. therefore, neither of them are innocent. which came first, the chicken or the egg, is a totally different discussion... First a Georgia Court and then an Ohio court ruled that blowing smoke in someone's face is an intentionally harmful or offensive contact that the subject would take negatively; a definition of assault and battery. I remember being out in Vegas a few years back, and one of the blackjack dealers said they had a class action suit against the casinos about 2nd hand smoke. Interesting to see there are other cases out there. Dick is an ass for doing what he did, no matter how trivial some may think it was. And yes, I think Jen was wrong for what she did. Dick is older than me (and I'm old!) and should know better...but after watching him for the last 7 weeks...I doubt he's more mature than an 8th grader. They've basically saved Eric and Dick, and they may do the same for Jen. She's currently second on the CBS Favorite Houseguest Poll with about 22%, the only one ahead of her is Dick.
